Not guilty verdict in shooting by illegal immigrant offers sanctuary from common sense

“As a rule, I don’t offer opinions about books I haven’t read and movies I haven’t seen. I feel the same way about trials I haven’t followed. I mean really followed, the way the whole country hung on every twist in the O.J. Simpson case.

Last week, a jury in San Francisco acquitted Jose Ines Garcia Zararte of murder in the 2015 shooting of Kate Steinle. While I was aware the trial was taking place, I wasn’t in the courtroom when the prosecution and defense teams made their arguments. I didn’t read transcripts of the witnesses’ testimony, only cursory news reports that would occasionally catch my eye. Still, I was predisposed to believe Zarate guilty.

It’s fortunate for Mr. Zarate I wasn’t on the jury.

To recap, on July 1, 2015, Jose Ines Garcia Zarate, an illegal immigrant with a history of arrests who had previously been deported 5 times, claims he found a gun wrapped in cloth under a bench along the waterfront in San Francisco. The gun went off/was fired — depending on which version of his story you believe — striking 32-year old Kate Steinle in the lower back. The bullet tore through Kate’s abdominal aorta, ending her life.

Surveillance video led police to Zarate, then going by the name of Juan Francisco Lopez-Sanchez, one of several aliases he used. The Steinle case blew up in the media not just because Kate was a beautiful young woman struck down in broad daylight while walking with her dad, but also because it shoved the disaster of San Francisco’s sanctuary policies onto the front burner, an issue that helped propel Donald Trump to the White House.

Zarate was eligible for a 6th deportation at the time of the shooting. Had then-San Francisco County Sheriff Ross Mirarimi held him for deportation, as Immigration and Customs Enforcement has requested, he would not have been sitting on that bench to find a gun or anything else.

Zarate told investigators the gun went off accidentally when it fell to the ground after he unwrapped it. Then he changed his story, telling police he stepped on the gun, causing it to go off. But his story changed yet again; this time he admitted he fired the gun but said he was aiming at a seal.

What’s not in dispute is Zarate tossing the gun into San Francisco Bay before running from the scene.

During the trial, it was revealed the bullet that killed Ms. Steinle ricocheted 12-feet from where Zarate stood and struck Kate 78 feet away. This makes it highly unlikely Zarate was deliberately aiming at Kate and may well have led to the not guilty verdict.

By centering their case around the theory Zarate was playing a perverse game of Russian Roulette — firing randomly at passersby — the prosecutors may have overplayed their hand and undermined their credibility with the jury.

Still, the judge had given the jurors the option of finding him guilty of second-degree murder or manslaughter. Amazingly, or perhaps not if you consider we’re talking about San Francisco, they only found Zarate guilty on a minor gun charge.

Jose Garcia Zarate’s immigration status and previous arrests were never introduced as evidence in this case. “Nothing about his immigration status, nothing about the fact that he is born in Mexico had any relevance as to what happened on July 1st, 2015”, said his defense attorney.

And that’s true to a point.

But there is another point — if San Francisco had turned Zarate over to ICE as requested, Kate Steinle would be alive today.

If San Francisco didn’t advertise, literally, on bus benches and public transit, they’re a sanctuary city, Jose Zarate may not have chosen San Francisco as his American destination.

“We just want to get this over with and move on with our lives,” said Kate’s father, Jim, after the jury’s verdict was announced. “We want to think about Kate on our terms. Nothing’s been on our terms. It’s been on everyone else’s terms.”

And, of course, he’s right. Kate Steinle’s death became a political football in the 2016 presidential election and remains so to this day. Sadly, Kate is hardly the only victim of illegal immigrant violence.

In Los Angeles, some of us will never forget the 2008 murder of Jamiel Shaw II by a convicted gangbanger, Pedro Espinosa, who had been behind bars 24 hours before killing Shaw. I will never forget introducing Jamiel’s dad to Danielle Bologna, whose husband and two sons were also murdered by an illegal immigrant in San Francisco.

Or Don Rosenberg whose son, Drew, was run down and killed by Roberto Gallo, then living and driving illegally in the City by the Bay. The list of the dead is far too long for this column.

Kate Steinle’s death furrowed Don Lemon’s brow on CNN as he tried to comprehend the strange term “sanctuary city,” as if he had never heard it before, but those of us in Los Angeles have had 39 years’ experience with sanctuary policies, ever since Special Order 40 was implemented by the LAPD back in 1979.  Proponents claim it makes America safer. Tell that to Jim Steinle.

ICE will once again attempt to deport Jose Garcia Zarate. Will San Francisco cooperate this time? And if so, how long before he’s back in the United States, thanks to our porous borders and the unwillingness of cities like San Francisco and Los Angeles to enforce our own laws?”

“#BoycottSanFrancisco is going viral as San Francisco defends its sanctuary policies in the wake of the not-guilty verdict in the Kate Steinle murder trial.

On November 30, Breitbart News reported that a California jury found seven-time felon and five-time deported illegal alien Jose Garcia Zarate not guilty of murdering 32-year-old Kate Steinle in 2015 in the sanctuary city of San Francisco.

According to the San Francisco Chronicle, local leaders denounced Trump’s position. State Sen. Scott Wiener (D-San Francisco) said, “People have every right to be critical of the verdict and speak out about that…[but] the president is using this to fan the flames of hatred against immigrants, to demonize immigrants.”

Former State Sen. Mark Leno (D) also criticized Trump, claiming he has “no shame.”

Mayor Ed Lee’s (D) spokeswoman said, “San Francisco is and always will be a sanctuary city.”

Twitter users throughout the nation and the world reacted to the defense of sanctuary policies by taking #BoycottSanFrancisco viral.”

‘0 Minutes’: MSNBC Ignores Kate Steinle Trial Verdict

“While most networks offered mixed coverage to the trial of an illegal immigrant accused of killing Kate Steinle, one network ignored the case’s verdict altogether, Pete Hegseth reported.

Hegseth said MSNBC did not cover the verdict of Jose Ines Garcia Zarate at all.

Zarate was found guilty on a weapons charge, but acquitted of more serious manslaughter and murder charges.

“They ignored it all together because to them it wasn’t news,” The Federalist’s Bre Payton said.

Payton said Zarate didn’t deny shooting Steinle, but the fact that the 45-year-old is a five-time deported illegal immigrant felon didn’t fit the network’s narrative.

Hegseth said CNN moderately covered the verdict, but dropped coverage in favor of reporting that Gen. Michael Flynn [Ret.] pleaded guilty to lying to federal authorities when that story broke.”

‘I was horrified’ Pleasanton residents outraged at Kate Steinle verdict

“SAN FRANCISCO (KGO) —

Reaction came down quickly from residents in Kate Steinle’s hometown of Pleasanton Thursday night after a not guilty verdict was read out by the jury.

“I thought it was ridiculous. I honestly thought it was ridiculous,” said Pleasanton resident Victoria.

The shocking verdict in the murder trial has many in Pleasanton fuming.

“I was horrified it would be a not guilty,” said another resident Diana Armario. “To me and everybody I know it was just an obvious guilty verdict.”

Steinle grew up in the East Bay town about 40 miles outside San Francisco and graduated from Amador Valley High School.

She was living in San Francisco when she decided to take that fateful walk onto Pier 14 with her father.

Many Pleasanton residents have been invested in the case and were stunned by the jury’s decision. They say justice has not been served.

“It’s just shocking that someone would get away with shooting a gun and murdering somebody and get away with it really,” said

“If I’m somebody who is walking with my daughter in San Francisco and the next thing, she ends up dead — somebody has to pay the price,” said Pleasanton resident Tony Budema.

Some blasted San Francisco for being a sanctuary city. And Steinle’s accused killer, who was deported five times, should have never been allowed to be there.

“You know one of the things about San Francisco being a sanctuary city is something that I personally don’t agree with and I think this is a perfect example of it,” added Liz Venema.

Steinle’s family still lives in Pleasanton. They were not in court when the verdict was read but told the San Francisco Chronicle they were “shocked and saddened.”

The only count Zarate was found guilty on was felony possession of a weapon.

Thirty-two-year-old Steinle was shot and killed on a pier in San Francisco in 2015 while walking with her father. Her final words were pleas to her father for help, as she died in his arms.

Zarate, previously known as Juan Francisco Lopez Sanchez, previously confessed to shooting Steinle in a jailhouse interview with a local ABC News affiliate. He also told the outlet that he had chosen to go to San Francisco because he knew it was a sanctuary city.”

“Hillary Clinton has pledged amnesty in her first 100 days, and her plan will provide Obamacare, Social Security and Medicare for illegal immigrants – breaking the federal budget. On top of that, she promises uncontrolled low-skilled immigration that continues to reduce jobs and wages for American workers, especially African-American and Hispanic workers. This includes her plan to bring in 620,000 new refugees in a four-year term.

Now that you’ve heard about Hillary Clinton’s plan – about which she has not answered a single substantive question – let me tell you about my plan.

While Hillary Clinton meets only with donors and lobbyists, my plan was crafted with the input from federal immigration officers, along with top immigration experts who represent workers, not corporations. I also worked with lawmakers who’ve led on this issue on behalf of American citizens for many years, and most importantly, I’ve met with the people directly impacted by these policies.

Number One: We will build a wall along the Southern Border.

On day one, we will begin working on an impenetrable physical wall on the southern border. We will use the best technology, including above-and below-ground sensors, towers, aerial surveillance and manpower to supplement the wall, find and dislocate tunnels, and keep out the criminal cartels, and Mexico will pay for the wall.

Number Two: End Catch-And-Release

Under my Administration, anyone who illegally crosses the border will be detained until they are removed out of our country.

Number Three: Zero tolerance for criminal aliens.

According to federal data, there are at least 2 million criminal aliens now inside the country. We will begin moving them out day one, in joint operations with local, state and federal law enforcement.

Beyond the 2 million, there are a vast number of additional criminal illegal immigrants who have fled or evaded justice. But their days on the run will soon be over. They go out, and they go out fast.

Moving forward, we will issue detainers for all illegal immigrants who are arrested for any crime whatsoever, and they will be placed into immediate removal proceedings. We will terminate the Obama Administration’s deadly non-enforcement policies that allow thousands of criminal aliens to freely roam our streets.

Number Four: Block Funding For Sanctuary Cities

We will end the Sanctuary Cities that have resulted in so many needless deaths. Cities that refuse to cooperate with federal authorities will not receive taxpayer dollars, and we will work with Congress to pass legislation to protect those jurisdictions that do assist federal authorities.

Number Five: Cancel Unconstitutional Executive Orders & Enforce All Immigration Laws

We will immediately terminate President Obama’s two illegal executive amnesties, in which he defied federal law and the constitution to give amnesty to approximately 5 million illegal immigrants.

Since 2013 alone, the Obama Administration has allowed 300,000 criminal aliens to return back into U.S. communities – these are individuals encountered or identified by ICE but who were not detained or processed for deportation.

My plan also includes cooperating closely with local jurisdictions to remove criminal aliens.

We will restore the highly successful Secure Communities program. We will expand and revitalize the popular 287(g) partnerships, which will help to identify hundreds of thousands of deportable aliens in local jails. Both of these programs have been recklessly gutted by this Administration. This is yet one more area where we are headed in a totally opposite direction.

On my first day in office, I am also going to ask Congress to pass “Kate’s Law” – named for Kate Steinle – to ensure that criminal aliens convicted of illegal reentry face receive strong mandatory minimum sentences.”

“SAN FRANCISCO — A judge on Tuesday refused to dismiss a second-degree murder charge against the illegal immigrant accused of fatally shooting a woman who was strolling on a city pier last summer in a case that sparked a national uproar over immigration policy.

Attorneys for Juan Francisco Lopez-Sanchez had asked the judge to throw out the charge in the death of Kate Steinle, 32, arguing that police had improperly detained him for seven to eight hours before questioning him.

But San Francisco Superior Court Judge James P. Collins denied the request in a quick hearing, ruling that police acted properly in arresting Lopez-Sanchez based on witnesses’ cellphone photos and descriptions of a disheveled man leaving the chaotic scene.

Steinle, a former Pleasanton resident, was walking on Pier 14 when she was shot in the back July 1. As she collapsed into her father’s arms, Jim Steinle said, her dying words were: “Help me, Dad.”

The killing — and revelations that the suspect had been repeatedly deported to Mexico — sparked a national outcry just days after Republican presidential candidate Donald Trump brought illegal immigration to the center of his campaign by saying Mexico was sending drugs, crime and rapists to the United States.

Lopez-Sanchez, who has entered the U.S. illegally five times, became a symbol of the national debate over border patrol, deportation and sanctuary programs.

Shortly before Steinle’s killing, Lopez-Sanchez finished a federal prison term and was brought to San Francisco to face minor drug charges based on a warrant more than a decade old. But he was released onto the city’s streets under San Francisco’s Sanctuary City program rather than being turned over to U.S. Immigration and Customs Enforcement for deportation.

And remember that Gov Moonbeam has made it simple and easy for people in the country illegally to obtain a state driver’s license, that will allow the bearer to board an airplane or buy a gun or anything else.

It doesn’t take a seer to see this could end disastrously.
