NBC Ignores Own Exclusive: Senate Probe Found No Evidence of Collusion

“According to an NBC News exclusive that first aired during the 10 o’clock hour of Tuesday morning’s MSNBC Live, both Republican and Democratic sources on the Senate Intelligence Committee admitted they had not found any direct evidence of collusion between the Trump campaign and Russia. Despite the fact the exclusive was filed by NBC News intelligence and national security reporter Ken Dilanian, NBC Nightly News hid it from viewers. Meanwhile, ABC’s World News Tonight and the CBS Evening News also turned a blind eye.

Instead of reporting on their massive breaking news story that drove a flood of reporting by other outlets, NBC Nightly News and anchor Lester Holt chose to hype DNA tests for dogs. [UPDATE: NBC skipped its own reporting again on Today.]

When the story first broke, a seemingly shocked Hallie Jackson came back from a commercial break to announce their discovery. “NBC News exclusive reporting on the Senate Intelligence Committee. Their investigation into Russian election interference and what they have and have not uncovered,” she said as she introduced Dilanian.

Wasting no time in getting to the heart of what his reporting discovered, Dilanian declared: “Hallie, after two years and after interviewing more than 200 witnesses, the Senate Intelligence Committee has not uncovered any direct evidence of a conspiracy between the Trump campaign and Russia.

Dilanian noted that committee chairman, Senate Richard Burr (R-NC), confirmed that finding to another network the other day, but he wanted to see what Democrats on the committee had to say. “[W]hat I’ve been doing since then is checking with my sources on the Democratic side to understand the full context of his remarks because that was essentially a partisan comment from one side, but this is a bipartisan investigation and what I found is that the Democrats don’t dispute that characterization.

Trump Demands Gavin Newsom Return $3.5 Billion for Canceled Bullet Train; Newsom: It’s ‘California’s Money’ Now

“President Donald Trump demanded Wednesday evening that the State of California return $3.5 billion in federal funds after Gov. Gavin Newsom canceled most of the state’s high-speed rail project, saying it was too expensive.

“California has been forced to cancel the massive bullet train project after having spent and wasted many billions of dollars,” the president tweeted. “They owe the Federal Government three and a half billion dollars. We want that money back now. Whole project is a “green” disaster!”

Newsom devoted the opening portion of his first “State of the State” address Tuesday to attacking Trump and his policies on the border. Yet he then bowed to conservative criticism — and, arguably, to fiscal reality — by canceling the high-speed rail project championed by his predecessors.

The governor added that while the bullet train would no longer connect San Francisco and Los Angeles, as first envisioned, the state would still continue “phase one” of the project between the rural towns of Bakersfield and Merced. “I know that some critics will say this is a ‘train to nowhere,’” he said. “But that’s wrong and offensive.”

Newsom added that the state had to continue the project if it wanted to keep the federal funds it had taken: “I am not interested in sending $3.5 billion in federal funding that was allocated to this project back to Donald Trump.”

The money was granted to California as part of President Barack Obama’s stimulus, which set aside “$8 billion in federal stimulus money to create 13 high-speed rail corridors,” the New York Times reported at the time.

Obama pressured states to take the cash — which Democrat-governed states eagerly did. But the Republican wave of 2010 brought new governors to office, and several rejected their state’s high-speed rail plans as costly and unnecessary.

California has already spent over $5 billion on the high-speed rail project — roughly the same amount that Trump had requested for the border wall.”

Russia Investigation

Senate has uncovered no direct evidence of conspiracy between Trump campaign and Russia

“WASHINGTON — After two years and 200 interviews, the Senate Intelligence Committee is approaching the end of its investigation into the 2016 election, having uncovered no direct evidence of a conspiracy between the Trump campaign and Russia, according to both Democrats and Republicans on the committee.

But investigators disagree along party lines when it comes to the implications of a pattern of contacts they have documented between Trump associates and Russians — contacts that occurred before, during and after Russian intelligence operatives were seeking to help Donald Trump by leaking hacked Democratic emails and attacking his opponent, Hillary Clinton, on social media.

“If we write a report based upon the facts that we have, then we don’t have anything that would suggest there was collusion by the Trump campaign and Russia,” said Sen. Richard Burr, R-N.C., the chairman of the Senate Intelligence Committee, in an interview with CBS News last week.

Burr was careful to note that more facts may yet be uncovered, but he also made clear that the investigation was nearing an end.

“We know we’re getting to the bottom of the barrel because there’re not new questions that we’re searching for answers to,” Burr said.

On Tuesday, Burr doubled down, telling NBC News, “There is no factual evidence of collusion between the Trump campaign and Russia.”

Sen. Mark Warner, D.-Va., ranking member of the committee, told reporters in the Capitol Tuesday that he disagrees with the way Burr characterized the evidence about collusion, but he declined to offer his own assessment.

“I’m not going to get into any conclusions I have,” he said, before adding that “there’s never been a campaign in American history … that people affiliated with the campaign had as many ties with Russia as the Trump campaign did.”

Democratic Senate investigators who spoke to NBC News on condition of anonymity did not dispute Burr’s characterizations, but said they lacked context.

“We were never going to find a contract signed in blood saying, ‘Hey Vlad, we’re going to collude,'” one Democratic aide said.

The series of contacts between Trump’s associates, his campaign officials, his children and various Russians suggest a campaign willing to accept help from a foreign adversary, the Democrats say.

By many counts, Trump and his associates had more than 100 contacts with Russians before the January 2017 presidential inauguration.

Report: Jared Kushner Didn’t Disclose $1 Billion in Loans, Investment Ties to Goldman Sachs, George Soros and Chinese Co. Alibaba

President Trump’s son-in-law and senior adviser Jared Kushner didn’t disclose his part ownership of a real-estate finance startup known as Cadre, according to a Wall Street Journal review of Kushner’s securities and other filings.

The Journal notes that Kushner’s Cadre stake “means the senior White House official is currently a business partner of Goldman Sachs Group and billionaires including George Soros and Peter Thiel.” The Journal also reports that Kushner didn’t disclose a number of loans “totaling at least $1 billion, from more than 20 lenders,” on properties and companies he co-owns; and Kushner “has also provided personal guarantees on more than $300 million of the debt.” An analysis of the debt on these assets “found ties to a broad swath of U.S. and foreign banks, private-equity firms, real-estate companies and government-owned lenders.”

[Kushner’s lawyer Jamie] Gorelick said the Cadre stake is described in a revised version of [Kushner’s] financial-disclosure form that will be made public after it has been certified by ethics officials. She said Mr. Kushner has previously discussed his Cadre ownership with the Office of Government Ethics and that Mr. Kushner has “resigned from Cadre’s board, assigned his voting rights, and reduced his ownership share.” A spokesman for the Office of Government Ethics didn’t immediately respond to a request for comment.

Mr. Kushner co-founded Cadre in 2014 with his brother Joshua and Ryan Williams, a 29-year-old friend and former employee of Kushner Cos., the family-controlled business that Mr. Kushner ran until recently. Cadre markets properties to prospective investors, who can put their money into specific buildings or into an investment fund run by Cadre, which collects fees on each deal.

To get off the ground, Cadre turned to a Goldman Sachs fund and a number of high-profile investors. Among them were the venture-capital firms of Mr. Thiel, Silicon Valley’s most prominent supporter of Mr. Trump, and Vinod Khosla, a co-founder of Sun Microsystems Inc., according to Cadre’s website. Other backers include Chinese entrepreneur David Yu, co-founder with Alibaba Group Holding Ltd.’s Jack Ma of a Shanghai-based private-equity firm, hedge-fund manager Daniel Och and real-estate magnate Barry Sternlicht, people close to Cadre said.

Cadre also secured a $250 million line of credit from the family office of George Soros, a top Democratic donor whom Mr. Trump criticized during his presidential campaign, the people close to the company said. Mr. Soros’s family office is also an investor in Cadre.”

Comey: Why no, we won’t be charging Huma Abedin for forwarding classified emails to Anthony Weiner

“Say this for the guy: He may be misapplying federal statutes but he’s misapplying them consistently, at least as far as Team Clinton goes. Ed noted earlier that Comey revealed this morning that Huma was forwarding emails to Weiner to print out for Hillary’s perusal. Did Huma realize that was illegal? Nope, says Comey, and that was the key. Somehow the thought didn’t occur to Hillary’s top aide that transmitting sensitive correspondence involving the world’s most powerful diplomat to unauthorized recipients might tickle the boundaries of what federal law permits.

Is Comey right, though, that there’s no crime here so long as Abedin didn’t intend to mishandle classified information? Nope. The statute is clear:

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—

Shall be fined under this title or imprisoned not more than ten years, or both.

Sending classified info to the private laptop of someone who isn’t authorized to receive it because you can’t be bothered to print it out yourself does sound suspiciously like gross negligence, especially given Weiner’s other computer pastimes and the opportunities they created for foreign blackmail. (Weiner’s participation here makes the negligence “gross” in every sense of the word.) But then, so does setting up your own private “homebrew” email server to conduct official state business. Comey decided last summer that it doesn’t matter what the federal statute actually says; Congress can write whatever laws it wants but when it comes to applying them, prior DOJ practice will guide the FBI in recommending charges, not the text of the law. And DOJ practice requires proof of knowledge or intent, not mere gross negligence, to justify filing charges, never mind that no one as high up as a Secretary of State had ever been credibly accused of violating this particular statute before. If Hillary’s gross negligence wasn’t enough to get her charged, then Huma’s gross negligence isn’t enough either.”

Paul Ryan’s Spending Bill Forbids Funding for Trump Wall – But Allows Funding for Border Security in Middle East

“House Republicans released its $1.1 trillion 1,665 page spending bill that includes an average of approximately 210 words per page — —or about twice as long as the stimulus law (the “American Recovery and Reinvestment Act”) that President Barack Obama signed less than a month after his inauguration in 2009.

Speaker Paul Ryan and GOP leaders inserted language that specifically restricts any and all funding of the Trump border wall.

However Paul Ryan’s bill will provide funding for border security in Jordan and Lebanon.”

Mexico’s Government Warns U.S.A. to Not Build Border Walls

“The Mexican foreign secretary called the plan to build walls along the border a “hostile” and “deeply unfriendly” act, and an “aggravating action”. He warned that Mexico intends to conduct a fierce legal battle to stop any border walls that violate the rights of Mexicans.

Mexico Foreign Secretary Luis Videgaray said building any walls when there are already 600 kilometers of barriers is not only a hostile and deeply unfriendly act, but one that “also is not going to fulfill the objectives that it raises, is not only an aggravating action, but it seems to be frankly a bad idea.”

The foreign secretary said Mexico is planning a legal fight, and it has no intention to pay for any border walls or to cooperate with the U.S. in any way on the development of border walls.

“Of course, any kind of financial cooperation or any other way in building the physical barrier between our nations and, of course, an important fundamental limit is not accepting the violation of the human rights of Mexicans in the United States.”

Videgaray charged that any border wall “is not part of a bilateral discussion and should not be, Mexicans should not be part of that discussion, we will not collaborate in any way the construction of something that hurts us, Is apparently an absolute waste of resources.”

Videgaray made this vow during his appearance before the Committee on Foreign Relations of the Chamber of Deputies in Mexico City this week.

The foreign secretary said that his country had put together “a very significant amount of human resources” to argue that the U.S. is violating international treaties, “starting with the ominous Treaty of Guadalupe in 1948.” This was most likely a reference to the 1848 treaty that ended the Mexican-American war and set the Rio Grande as a boundary to Mexico.

He forewarns that Mexico will file lawsuits in the U.S., as well as in international courts of law if there are any violations of a border treaty, environmental treaties, or an international law regulation.

Secretary Videgaray told the Committee on Foreign Relations that Mexico “has been a tireless promoter of openness to the world, to open up to us,” for decades. He urged, “we must recognize that we face new circumstances, some of them unpublished and others that are reminiscent of things that happened to the world decades ago.”

“Today in the world there are threats to our paradigms of international coexistence that have been in force for decades. It is undeniable that there are outbreaks of isolationist protectionism, outbursts of nationalism that try to close the world and beyond that, from political actors of very diverse origins in different latitudes, question the principle of global integration.” In the same speech, he said, “first and foremost as it should be,” the United States must recognize Mexico as a sovereign nation.

The Mexican foreign secretary threatened that any attempt to tax remittances from the U.S. would be “a break point in any dialogue on other issues.” He called the “flow of foreign exchange” “a fundamental support for many families.” “[F]or Mexico, [it] is a non-negotiable issue,” he charged.

In his address, Videgaray also vowed that Mexico would “increase significantly the attention to Mexicans abroad.” Videgaray explained that the 50 Mexican consulates have assisted and protected 45,290 this year – “more than half were in the immigration field.”

There have been 2,400 migrants who have been provided legal representation, and they are representing those who have already been deported.

The foreign secretary said Mexico would never accept a unilateral decision by the United States to send migrants from other countries to Mexico, and the country is waiting to challenge executive orders “regarding the extension of the criteria to allow express deportation.” They are “waiting for the first act of implementation, not only the Mexican government but the allied organizations, non-governmental organizations, so that when the first act of application exists, proceed to challenge the general rule,” he said. “There is not yet an act of application regarding the criterion of expeditiously deporting someone who has more than 14 days in the country or someone who is beyond 100 kilometers of internment.”
